This memorandum sets out a few brief examples (there are
many others) of the attitude of the Courts and various disciplinary bodies to
solicitors found guilty of wrongfully certifying or dating documents or
otherwise making false or misleading statements to others.

  1. In the New South Wales case of Demetrios v Gikas Dry Cleaning Industries
    Pty Ltd (1991) 22 NSWLR 561
    , the NSW Court of Appeal considered the
    position of a solicitor who had signed a mortgage as witness to the signatures
    of both husband and wife, although the wife was not present when the document
    was purportedly witnessed by the solicitor. Two of the judges (at 565) stated
    that the solicitor?s conduct conveyed ?a material misrepresentation to the
    solicitor for the vendor?. The Legal Profession Disciplinary Tribunal then held
    in Re Demetrios [1993] 3 LPDR 3 at 6
    that ?The conduct of the solicitor in signing his name as witness of a
    signatory on documents that were not signed by that signatory in his presence
    is clearly conduct which would be regarded as disgraceful and dishonourable by
    solicitors of good repute and competency.?

  2. In another New South Wales case with similar
    facts, Law Society of New South Wales v
    Georgas
    [2008] NSWADT 82 at [38], the tribunal agreed with the submission
    of the Law Society of New South Wales that ? ?any solicitor who purports to
    witness a signature of a person in circumstances where the solicitor does not
    see the person whom the signature purports to represent sign a document?must be
    prima facie guilty of conduct which, on any definition, can only be described
    as professional misconduct.?

  3. In a Queensland case, Attorney-General v Bax [1999] 2 Qd R 9, where a solicitor, among
    other things, ante-dated a deed of loan and deceived a creditor?s meeting, one
    of the judges of the Queensland Court of Appeal remarked, ?The spectacle of a
    solicitor, who was chairman of the meeting, falsely asserting a date for the
    execution of an instrument is one that is not likely to be readily forgotten by
    the large number of business people who were present on that occasion. It
    conveys a very poor image of the honesty and integrity of solicitors and so
    tends to bring the whole profession and its standards into disrepute.?

  4. Legal
    Services Commissioner v Ramsden
    [2006] LPT 010 (Queensland Legal Practice
    Tribunal) was a case where a solicitor was reprimanded and fined for
    post-dating a mortgage to avoid stamp duty penalties.

  5. Prothonotary
    of the Supreme Court of New South Wales v Chapman
    (CA (NSW) 14 December
    1992, unreported, BC9201419) was a case where the solicitor made false
    declarations in registering a business name, and allowed clients to use false
    names in accounts. Apparently the solicitor did this to protect his prostitute
    clients from harassment. However the Court said (at 20) that this conduct ?was
    not the conduct expected of a solicitor?.

General conclusions cannot be drawn without looking at the
individual circumstances of each case.?
However it is reasonable to say as a general proposition that lawyers
are expected to act with candour and honesty in their dealings with others, and
this outweighs their responsibilities to their clients.? As remarked in one of the leading Australian
textbooks on lawyers? professional conduct, which cites the cases referred to
above, and numerous others: ?Although making false or misleading statements to
the court clearly strikes at the heart of the administration of justice, for a
lawyer to knowingly or recklessly make false or misleading statements to
persons other than the court ? whether to a client, an opponent, a professional
body or other tribunal, or otherwise a person who relies on those statements ?
is likewise indicative of dishonesty. It therefore amounts to professional
misconduct, or at least unsatisfactory professional conduct.? Riley Solicitor?s Manual ?[35,035].

Connecticut tourism gets boost from filmmaker Ken Burns

HARTFORD, Conn. --?Connecticut's tourism industry is getting a boost from documentary filmmaker Ken Burns.

Burns announced Wednesday that he has partnered with a luxury tour group, Tauck Tours of Norwalk, on a redesigned eight-day tour of New England's "hidden gems," which will include a two-day stop in Hartford. The company said it added the Hartford stop at Burns' urging.

Best known for his award-winning documentaries on the Civil War and baseball, Burns and Gov. Dannel P. Malloy made the announcement at the Mark Twain House, which will be highlighted on the tour along with the home of 19th century abolitionist Harriet Beecher Stowe, who wrote "Uncle Tom's Cabin."

"The tourism industry employs about 110,000 people, generates more than $1 billion in state and local tax revenue and brings more than $11 billion in spending to our state," Malloy said in a statement. "While our 'Still Revolutionary' marketing campaign is already paying dividends, the addition of this overnight stop in Hartford demonstrates that there is still much untapped potential for tourism in the coming years."

The bus tour will run from June through the fall foliage season, and also include stops at Lexington, Concord, and Fenway Park in Massachusetts, a Shaker community in New Hampshire, the Green and White mountains, and at Burns' studio in Walpole, N.H.

"My mission in making films has always been to explore who we are as Americans," he said. "Mark Twain and Harriet Beecher Stowe had a similar goal, at a time when the experience and definition of 'being an American' was entirely dictated by the color of one's skin. These two remarkable individuals asked difficult questions of their country, and we became a better place for it."?

Khubeka, Louw to set Maseru alight : Lesotho Times

MASERU ? South Africa?s legends Abigail Kubeka and Marah Louw are billed to share the stage with local Afro-jazz sensation Paul Qebe known as Khakheni at ?Manthabiseng Convention Centre on November 2.

The trio will perform at a show dubbed the Legendary Divas Tour which has been organised by a Cape Town-based company Retail Leaders.

The group, that also includes Dorothy Masuku, got together in July last year for the Bastille Day event and performed a special tribute to the late Miriam Makeba.

Retail Leaders business manager, Janke Jabbie, told the Weekender that Khakheni shared the stage with Kubeka and Louw during the latter?s 60th birthday celebrations on July 17.

?The show was a huge success. This led the divas inviting Khakheni to be their opening act on their tour to Lesotho,? she said.

?Very unfortunately though, Dorothy Masuku won?t be part of the line-up due to other commitments.?

She added: ?The tour is intended to continue for the next six months in South Africa and other southern African countries.?

Jabbie said the tour is a celebration of the trio?s 50th anniversary in the arts and entertainment industry.

?The show in Lesotho is also meant to promote Louw?s new album titled Marah Worships the African way.

?Some of the songs they are going to perform are those by Makeba so they will also be paying homage to Makeba who was also their friend within their repertoire,? she said.

Jabbie told the Weekender that the collaboration with local artistes will add value and promote Lesotho?s arts and entertainment industry.

?We are going to have a few surprises locally but they will be unveiled at the show,? she said.

Khakheni in a separate interview told the Weekender that sharing the stage with the two South African divas will give him more exposure as an artiste.

?It will add more energy in the sense that I have more gigs coming my way after this performance,? Khakheni said.

The 50-year-old said sharing the stage with these much celebrated artistes on home soil is an honour.

?It is going to be an honour for me to be performing in front of my fellow countrymen and women on home soil,? Khakheni said.

?It is also going to give me more exposure as we are going to many places and countries soon after the local show.?

Khakheni ? whose only album Thusa Ntate was released in 2008 ? said he will also be performing in public for the first time with his music group.

?This will also be my very first performance with Bayete both as their leader and group member,? he said.

Meanwhile, Jabbie said the show will start at 8pm. Tickets are being sold at Computicket at M250 each.

?The legendary divas Abigail Kubeka, Marah Louw and Dorothy Masuku are true South African icons who are well respected and admired for their important and distinguished contribution to the arts and entertainment industry spanning over 50 years,? she added.

Jabbie said the three divas received positive review since their first collaboration in July.

The department of Humanities and Human Sciences invites applications for a tenure-track Assistant Professor, beginning Fall 2013. The appointment will primarily entail teaching first-year composition classes. There may be opportunities to offer coursework in technical writing, advanced argumentative or expository writing, or public speaking. ScienceDaily (Oct. 23, 2012) ? What happens in the brain when we see, hear, think and remember? To be able to answer questions like this, neuroscientists need information about how the millions of neurons in the brain are connected to each other. Scientists at the Max Planck Institute for Medical Research in Heidelberg have taken a crucial step towards obtaining a complete circuit diagram of the brain of the mouse, a key model organism for the neurosciences. The research group working with Winfried Denk has developed a method for preparing the whole mouse brain for a special microscopy process. With this, the resolution at which the brain tissue can be examined is so high that the fine extensions of almost every single neuron are visible.

Neurons transmit information through their extensions -- the axons -- and form a complex network of connections, which provides the basis for all information processing in the brain. Analysing this network under the microscope is one of the biggest challenges facing the neurosciences. Most axons are less than one micrometre thick, some even smaller than 100 nanometres. "The electron microscope is the only microscope with a high enough resolution to enable individual axons lying next to each other to be distinguished from each other," says Winfried Denk. Despite their minute diameter, axons can become very long and extend from one end of the brain to the other. To obtain an overall picture of a brain, the researchers have to analyse large pieces of tissue.

In 2004, scientists working with Denk developed a new method that enabled them to do just this: "serial block-face" scanning electron microscopy. To examine tissue using this method, it must be fixed, stained and embedded in synthetic material. This works for small pieces of tissue, but up to now it was not possible for tissue the size of a mouse brain. In a current study, Shawn Mikula from Denk's department succeeded in preparing a mouse brain in such a way that he was able to analyse it using block-face microscopy and trace the axons. The Max Planck research group would now like to image a whole brain with the "serial block-face" microscope so that they can study the neuronal connections in the entire mouse brain.

In their latest study, the Heidelberg-based researchers demonstrated that the brain of a mouse can be prepared in a way that enables it to be analysed whole using "block-face" electron microscopy. The challenge facing the scientists was to treat a large piece of tissue so that it is evenly fixed and stained right through to the inside. To do this, they developed a complex process in which the brain is treated in different fixing and staining solutions for days.

With scanning electron microscopy, an electron beam scans the surface of a tissue section. A single electron microscope image thus corresponds to a cross-sectional view through the tissue. To obtain a three-dimensional image of a tissue, it is cut in fine sections using traditional methods, and these are then microscoped individually. This approach is not only tedious, it is also error-prone. Block-face microscopy overcomes this problem. This involves inserting an entire piece of tissue in the microscope and scanning the surface. Only then is a thin section cut, and the layer below is scanned. This makes it easier to combine the data on the computer.

In an initial analysis of the method, the scientists followed the axons of 50 randomly selected neurons and marked them by hand. The axons can be clearly reconstructed using the process. "However, it would take far too long to trace all of the neurons in this way as a mouse brain consists of around 75 million neurons," says Denk. Therefore, the image evaluation must be automated. "Our images have sufficient resolution and contrast to follow all myelinated axons. If we manage to scan an entire brain in the years to come, this should provide a major incentive for computer scientists to develop the necessary analysis methods."

A detailed map of the connections in the brain will make a major contribution to the clarification of neuronal functions. "Every theory on brain function is based on an idea of the corresponding information paths in the brain. It is very important that we find out about the connections between the nodes so that we can distinguish between different models of brain function," explains Denk.

Are Discounts Shrinking?

Whether they are flippers or buy-and-holders, more than a few investors? business plans rely heavily on healthy discounts between the price paid for a foreclosure or short sale and the full price a property can be expected to command after it has been renovated and rented or listed for sale.

It?s a good idea to play close attention to discount trends in your market, which may require a subscription to a good foreclosure data provider.? On the mythical national level, it?s also possible to get a sense for how discounts are faring.? Right now there are some unusual currents stirring the pond.

Like everything else in real estate economics, distress sale discounts are a function of supply and demand.? However, the factors that drive supply and demand for foreclosures may have little to do with traditional housing economics. Foreclosure supply is increasingly a function of where you live, state laws more than local economic conditions are determining the speed with which foreclosures are processed and, in turn, local inventories (see Foreclosures Split America). Short sales don?t suffer than problem, but to some degree still are limited by lenders.

On the demand side for foreclosures and short sales, is the arrival of big money hedge funds driving up prices?? What about first-time buyers who are finally waking up to the fact that market is passing them by?? Are new investors getting into the game before the rule change?? Are established investors doing as many deals as they can while discounts are still healthy?? I don?t know of any good data that answers these questions, but if you have an opinion, please leave a comment below and tell us what?s going on in your market.

The tight supply of foreclosures has been a major cause of the record low overall inventories that are driving the increase in home values this year.? ?Should prices for foreclosures and short rise faster than full price properties, discounts should shrink.? Depending on whose numbers you believe, though September national median existing home prices have risen from 2 to 11 percent, year-over-year.? Are distress sale prices exceeding that rate and shrinking discounts?

RealtyTrac probably has the best national numbers on discounts, since their data is based on actual transactions filed in the courthouse.? Through the second quarter discounts on properties in foreclosure or bank-owned sold at an average price that was 32 percent lower than the average price of a non-foreclosure home, a slight improvement from a 30 percent discount in the first quarter and also a 30 percent discount in the second quarter of 2011 (RealtyTrac?s third quarter data should be out soon).? ?So it?s safe to assume that distress sale prices were tracking overall prices fairly closely through the first six months of the year.

However, perhaps the RealtyTrac numbers don?t tell the whole story.? As any investor knows, the discount also reflects the condition of the property.? Have discounts on move-in ready foreclosures and short sales actually been shrinking or is the mix of damaged and move-in ready properties changing? Thousands of foreclosures coming on the REO market this year were tied in agonizing long processing delays due to Robogate.? No doubt they suffered damage as a result.? Demand is limited:? amateur investors and first-time buyers don?t buy seriously damaged properties.? Buyers are serious, experienced investors who know what they are doing.? ?Could it be that prime distressed sales have been cherry-picked in many markets, leaving the serious rehabs to the pros (See Why Short Sale Discounts are Growing & The Best Banks for Bargains)?

The National Association of Realtors conducts a monthly survey of its members called the Realtor Confidence Index .? The RCI covers a wide range of issues, from appraisals to sales to foreign investors. The NAR data is not as good as RealtyTrac, since it does not come from actual transactions but it still could give us a better understanding of what?s going on.

The September survey, posted yesterday, reported that foreclosures and short sales sold at deep discounts ? accounted for 28 percent of April sales (17 percent were foreclosures and 11 percent were short sales), down from 29 percent in March and 37 percent in April 2011.? Foreclosures sold for an average discount of 21 percent below market value in April, while short sales were discounted 14 percent. (Note: It?s not a good idea to compare these numbers directly with the RealtyTrac data since they come from very different sources.)

Realtors participating in the survey also rated the median prices for damaged foreclosures and short sales in their markets. ?Foreclosures in the lowest tiers, ?below average? or ?Bottom 1 percent? enjoyed a discount (29.4 percent to 36.1 percent) twice as deep as move-in ready properties and those requiring little work (15.2 percent to 17.0 percent).

It?s quite possible that a change in the mix of quality on the market today could be keeping median discounts? lower than they would be if the mix were the same as it was a year ago.? The fact that discounts have stayed steady in the RealtyTrac numbers may reflect this changing mix and may be masking a shrinking of the discount for top tier quality properties.? What do you think?? GOP Lawmaker Has No Regrets On Sensitive Docs Dump

BOCA RATON, Fla. -- Rep. Jason Chaffetz, a Republican congressman who has aggressively championed an investigation into the Obama administration's handling of the recent attack on a U.S. diplomatic outpost in Libya, told The Huffington Post on Monday that criticism of a House committee's decision to release sensitive State Department documents was little more than a smear campaign.

"That's right out of the Democrat playbook: Attack the messenger," said the Utah representative, who was working the post-debate spin room Monday night.

The documents released were part of the House Oversight and Government Reform Committee's ongoing investigation into the September assault on the Benghazi compound that left four Americans dead, including Ambassador Christopher Stevens. Republicans have accused the administration of failing to properly secure the compound and later misleading the public about what happened in the attack.

But this past Friday, the oversight committee, on which Chaffetz sits, came under stern rebuke from the State Department for its decision to make public more than 100 pages of internal government cables and other documents relating to the Libya attack. State Department officials told Foreign Policy's Josh Rogin, who first reported on the controversy, that the documents, while not classified, contained sensitive information, including the names of Libyan human rights activists and others who had worked with the U.S. government -- and whose names were not redacted by the committee.

Democrats spent much of the next few days piling additional criticism on the committee.

"This reckless and irresponsible release jeopardizes the lives and safety of our partners and their families," Rep. Nita Lowey (D-N.Y.) said in a statement. "There is no justification for playing political games with our national security and the well-being of Libyans working with us to achieve a more secure future."

The degree to which the documents should be treated as sensitive had earlier come up in a meeting between State Department officials and members of the oversight committee. According to a transcript of that Oct. 9 meeting released by the committee's top Democrat, Rep. Elijah Cummings (D-Md.), the panel's chairman dismissed as "crap" the administration's argument that documents marked "sensitive" or "for official use only" should not be made public.

"Anything below 'Secret' is in fact just a name on a piece of paper," the chairman, Rep. Darrell Issa (R-Calif.), said according to the transcript. "And I think it is important to understand that. So if you have seen papers that say 'for official use only,' 'State Department sensitive,' that is crap."

On Sunday, Issa issued a statement defending his decision to release the documents. He said that least one of the human rights workers who the State Department said had been exposed by the publication was already publicly associated with the U.S. government because of a past trip to the U.S. sponsored by State.

"President Obama should be ashamed of yet another example where his administration has been caught trying to mislead the American people about what happened in Libya," Issa said.

Chaffetz, who had joined Issa in signing the letter that accompanied the released documents, told HuffPost on Monday that he had no regrets about making them public.

"They're all unclassified documents," he said.

"The only one who showed classified information was the State Department," he added, referring to a contentious moment during a recent oversight committee hearing when Chaffetz halted the proceedings to object to a State Department official's detailed description of the Benghazi compound's layout.

Chaffetz's interjection may have drawn more attention to the official's remark. Reuters later reported that some portions of that exchange may have referred obliquely to a top-secret CIA facility.

"It's borne itself out that, yeah, that was classified, and they shouldn't have raised it," Chaffetz told HuffPost.

Chaffetz also said he was not concerned that Republican presidential nominee Mitt Romney had avoided talking about the specifics of the Libya controversy during Monday's debate.

"Mitt Romney's goal was to paint a vision for the world. Mitt Romney was pitch perfect," Chaffetz said. "No doubt the administration still has so many unanswered questions, but the direction of the questions [in the debate] just wasn't going that way. I've got some questions though."

Florida State's Thompson out for rest of season

TALLAHASSEE, Fla. (AP) ? Florida State running back Chris Thompson is out for the rest of the season after injuring his left knee in the Seminoles' win against Miami on Saturday.

The school made the announcement Monday.

Thompson was the 11th-ranked Seminoles' leading rusher he hurt his knee in the second quarter at Miami after making a 32-yard reception.

Thompson also missed much of last season with two broken vertebrae, and said he feared that back injury would end his career.

He had 47 yards on seven carries Saturday night, giving him a team-best 687 yards for the season. He also has 248 receiving yards.

Over the past few weeks and months, maybe even years, I have been writing increasingly about personal transformation. We have talked about using affirmations?and getting our butts in gear?. Beginning today and running for the next few weeks, rather than our usual affirmation poster or?wallpaper, I will post a weekly affirmation with some specific tips and questions to you dig a little deeper, and help propel yourself forward.?Don?t worry, I?m right here in the mix with you.

Let?s do this!

Affirmation: Each day, I move closer to my dreams.?

?

?My life is filled with almost endless possibilities,?and I can trust that my heart?s deepest longings are on their way. Because of these things, I have the courage to take action. Each day, I move a little closer to my dreams.

Some steps I take are big. I may enroll in a challenging course, begin the loan process for my?new business, or finish paying off an old debt. Whatever the step, however, I am confident that I am moving toward my highest vision of myself and my life.

Some steps are smaller. Just getting through a challenging day with a positive attitude is movement in the right direction. After all, I am happy about where I am heading in life. Therefore, maintaining positivity now is great practice, and is something I can do every day. Because I am in charge of my moods, my emotions and my responses to what is going on around me.

Sometimes, the actions I take may not even seem as though they connected to my goals. They may seem almost too small to be related my biggest? and best dreams. I trust, however, that as I hold my vision in my heart, I am guided. Each action I take moves me closer to my deepest yearnings.

Today, I trust in the fundamental rightness of my goals.?

I know that they, my goals, ?align with what I really want, and in time, they can be mine. Each day, I consciously take note of how I am moving closer to my dreams and give myself credit?for my hard work.?

?

Homework: Self-Reflective?Questions

1. What are some of my heart?s deepest longings?

2. If I feel like I am not moving forward towards those desires,?what seems to be in my way?

3. What can I do today to spur me on toward one of those dreams?

?

This is a short term?experiment.

My current plan is to do this every Sunday in preparation for our week ahead. But?I need for you to do four things for me.

1. Read the affirmation and statement aloud to yourself.

2. Write out your answers to the self-reflective questions. You don?t have to share them if you don?t want to, but write them down for your own benefit and boost.

3. Subscribe. If we continue this series, the only way you will get it on a regular basis is to subscribe.

4. Comment. I don?t usually press for comments, but as I continue to consider adding this additional feature to the blog, I am asking for feedback. If you liked it, or didn?t. If you see ways that I can tweak it to make it better. If you found the exercise helpful or not. If you had some kind of breakthrough, epiphany or wake up call. If you?d rather get this as a newsletter on a monthly basis. Anything?

Here?s the bottom line for this experimental feature. Because it will take some extra time to get these ready, no comments or feedback, no musings. Ok?

Calling an ambulance improves heart attack survival

ScienceDaily (Oct. 17, 2012) ? Patients with chest pain symptoms who call an ambulance have quicker, more appropriate treatment and better survival according to research presented at the Acute Cardiac Care Congress 2012. A study from Denmark shows that calling emergency services allows pre-hospital triage and transport to the most appropriate hospital, while a Turkish study reveals that only 29% of patients with chest pain went to hospital by ambulance.

The Acute Cardiac Care Congress 2012 is the first annual meeting of the newly launched Acute Cardiovascular Care Association (ACCA) of the European Society of Cardiology (ESC). It takes place from 20 to 22 October in Istanbul, Turkey, at the Istanbul Lufti Kirdar Convention and Exhibition Centre (ICEC).

Primary percutaneous coronary intervention (pPCI), also called balloon treatment, opens the coronary vessel and is preferred over intravenous (IV) medicine (called thrombolysis) to dissolve blood clots in patients with heart attacks. To deliver this care, patients must be transported to a hospital that can provide balloon treatment. This requires well functioning treatment networks which integrate the pre-hospital and in-hospital phases of patient management so that even patients in remote areas receive high quality treatment that adheres to ESC Clinical Practice Guidelines.

"Transporting patients to hospitals with balloon treatment capacity often involves bypassing local hospitals in the vicinity of the patient," said Dr Mikkel M. Schoos from the University Hospital of Copenhagen, Denmark. "Pre-hospital triage involves digital transmission of the ambulance electrocardiogram (ECG) using telemedicine to the attending cardiologist at the hospital with the balloon capacity who can decide if the patient needs balloon treatment."

He added: "In this way, patients can be referred directly to the hospital that can perform balloon treatment, without first being seen in a local emergency room. This saves important time. We know from previous studies that reduced time to treatment equals greater salvage of the heart tissue near the blood clot after a heart attack."

Dr Schoos' study investigated the quality of these treatment networks in Denmark. The researchers found that 75% of all patients can be transferred directly to hospitals with balloon treatment capacity using pre-hospital triage.

But even when well functioning pre-hospital triage with telemedicine is in place, for 25% of patients it is not possible to deliver treatment within the time targets recommended by ESC Clinical Practice Guidelines if only ground ambulance is used. These are patients who live more than 100km (60 miles) away from the hospital with balloon treatment facilities and patients who go to a local hospital first.

The study showed that patients who are first brought to a local hospital lose important time and this increases their risk of death. "The time delay caused by first being taken to a local hospital that does not have the treatment facilities the patient needs is bad for the patient," said Dr Schoos. "Our study also shows that this system delay predicts all cause mortality in these patients who have big heart attacks. That means that a pit stop at a local hospital increases the risk of death."

There are several reasons why patients might go to the local hospital first. One is that the heart attack is not developed enough to be detected and diagnosed by the ambulance ECG. Dr Schoos is currently investigating ways to improve early diagnosis with ECG or biomarkers in the blood. A second reason could be a failure to transmit the ambulance ECG to the hospital. A third reason is that emergency medical personnel are not confident that the patient is stable enough for further transport and decide to do a pit stop at a local hospital.

Dr Schoos said: "By doing that they postpone the only right treatment. The majority of patients with acute heart attacks can be safely transported to a hospital with the needed treatment capacity, even if these hospitals are further away than smaller local hospitals."

He added: "Even though patients might get arrhythmias, which are bad heart rhythms, as a consequence of their blood clot, these can easily be treated in the ambulance by well educated emergency medical staff."

Ambulance staff must also be educated to perform and transmit the ECGs. "We need people with the right education in the ambulance for these treatment networks to function properly," said Dr Schoos.

Dr Schoos continued: "Patients and their relatives should call the emergency telephone number (112 in Denmark and Turkey) at the first symptoms of a heart attack. Valuable time is lost when patients drive themselves to emergency rooms or are driven there by relatives and they could develop a bad heart rhythm on the way. Ambulance staff can do an ECG straightaway, even in the patient's home, and ensure that patients are taken to the right hospital immediately."

He added: "Calling emergency is also important in countries that don't use pre-hospital triage with telemedicine because ambulance staff can give anti-thrombotic medicine to dissolve or stop the development of a blood clot."

To improve treatment for patients who live more than 100km away from a hospital with balloon treatment, Dr Schoos recommended arranging the catchment area of a hospital into geographical zones. This would make it possible to identify patients who might have long treatment delays because they live further away.

Geographical zone 1 could be for patients who live within 100km of the balloon treatment centre. These patients can receive pre-hospital triage with telemedicine. Geographical zone 2 is for patients more than 100km away. These patients could be transferred by helicopter, or be treated first with clot dissolving drugs (thrombolysis) followed by balloon treatment when they arrive at the centre.

In the second study, Dr Burcu Demirkan from the Turkiye Yuksek Ihtisas Hospital in Ankara, Turkey, investigated the factors influencing the use of an ambulance among Turkish patients with an acute coronary syndrome (ACS).

"Until recently there was a limited ambulance service in Turkey but the Ministry of Health has now made it available for the whole country," said Dr Demirkan. "The service is free of charge and quicker than in the past. Despite these improvements most patients still prefer self transport instead of using an ambulance when they have acute chest pain."

For the study the researchers collected data from 330 patients with ACS from 2 hospitals (a state hospital without pPCI capability and an education and research hospital that could perform pPCI).

The study found that just 29% of patients went to hospital by ambulance. This was despite the fact that 68% of patients knew the emergency telephone number (112). There were no differences in age, gender and marital status between patients who called an ambulance and patients who did not.

Patients who called an ambulance had a higher level of education, greater knowledge of the risk factors for coronary artery disease, and greater awareness of the fact that chest pain is related to heart attack and patients should quickly seek medical care. These patients were also more likely to have ST-elevation myocardial infarction (STEMI) (as opposed to non-STEMI), vertigo, syncope/near syncope, nausea, vomiting and more severe chest pain.

Among patients who did not use an ambulance, 37% were given a lift, 14% drove their own car, 26% took a taxi, 12% used public transport and 11% walked to the hospital.

Most patients (whether they used an ambulance or did not) were accompanied by family members or friends during transportation to the hospital.

Dr Demirkan said: "Less than one third of Turkish ACS patients used an ambulance for transportation to the hospital even though this service is free. This rate was lower than rates from previous studies in European countries and Australia but similar to rates in China."

She added: "The perception of symptoms as not serious or not of cardiac origin was the most common reason for not calling an ambulance. However among the patients who considered the symptoms to be serious, most of them thought that self transport would be faster. Contrary to the assumption of these patients, we found that ambulance users arrived at the hospital more quickly."

Dr Demirkan continued: "Instead of using an ambulance most of our patients used transportation that was unsafe and inappropriate for ACS patients, who urgently need reperfusion therapy. This situation was due to patients' misperceptions about the symptoms of a heart attack or false assumptions that self transport would be quicker."

She concluded: "Our study improves understanding of the reasons why patients do not call an ambulance and will help with planning health education programmes to increase ambulance use. Such programmes should teach patients about the characteristics of chest pain related to heart attack and the importance of calling 112 when they experience these symptoms."

I?wish to congratulate ICANN for a successful meeting outcome, and the host country Canada for their superb hospitality.? The CN Tower was amazing!. ?I also thank the ICANN leaders for the opportunity to share my comments at this Public Forum.DCA Trust has been participating in the ICANN Global Community and attending the ICANN International Meetings regularly and actively within the past few years.

DCA Trust is also a new gTLD applicant, and has submitted an application for the .Africa generic Top-Level Domain.

This ICANN-45 Meeting in Toronto has provided a landmark opportunity for the presentation of the initial draft of the ICANN Africa Strategy. ?We are thankful for the increased attention that is now being given to Africa, in order to put it more firmly on the ICANN Global Map.

ICANN thrives on its multi-stakeholder, transparent and consensus-based approach to policy development and implementation. ?Meanwhile, the same multi-stakeholder approach is often criticized, but the critics of this model are unable to devise an alternative approach that could effectively replace the multi-stakeholder model, and serve the global public interest on issues of Global Internet Governance. A global Internet requires that different stake-holders participate in its governance, and that a proper forum is provided for any interested party to participate ensure that such voices are heard. At the very minimum, the debate will be enriched based on democratic principles. DCA will continue to support the multi-stakeholder concept, without needing to over-emphasize that in the absence of the multi-stakeholder model, DCA Trust, as a private, non-profit, non-partisan, independent organization will not have the opportunity to be heard in matters of Global Internet Governance and as an active participant in the global ICANN Community.

At the ICANN-44 Prague meeting, DCA Trust had been concerned that a preliminary meeting was held between some ICANN officials and certain group(s) of the African constituency at ICANN. ? DCA Trust was not invited to that meeting, for which reason we demonstrated our grievance by writing a letter to ICANN to protest our exclusion. It later transpired that the meeting was to lay the initial framework? for commencing the ICANN? Africa Strategy, and we interpreted our apparent exclusion from participating in that meeting as a prelude to our non-involvement in the process of the ICANN Africa Strategy ? both in formulation and implementation. We complained again based on multi-stakeholder principles. We strongly believe that all those participating as recognized constituents of the African Community at ICANN should be involved in any ICANN Africa Strategy. Even whilst maintaining that our initial complaints were valid, we also believe that all that is now in the past and that DCA Trust was able to make its point.

Accordingly, in moving forward towards future and positive cooperative endeavors, we are thankful to Mr. Tarek Kamel, the Senior Adviser to the ICANN President & CEO, who also has the primary responsibility for leading the formulation and implementation of the ICANN Africa Strategy. Mr. Kamel has been gracious enough to meet with DCA Trust here in Toronto and discuss the framework under which DCA Trust will participate in the ICANN Africa Strategy. To this end, DCA Trust is pleased to announce that it has developed a new initiative ? the Internet Business Council for Africa (IBCA) ? that is aimed at increasing the African private sector participation at ICANN; to be implemented as a component part of the ICANN Africa Strategy.

The principal objective of this initiative is to help promote and increase the multi-stakeholder diversity at ICANN in line with the broader strategic objectives of the ICANN Strategic Plan covering the three-year period that spans July 2013 to June 2016.? We envision that the inclusion and early adoption of the proposed IBCA initiative as a key component of the ICANN Africa Strategy will strengthen ICANN?s multi-stakeholder model; as the organization increases the visibility of its work and overall outreach/communication activities in Africa, and

DCA Trust is proud to propose this as a strategic input that would enable it achieve further levels of cooperation with ICANN in the implementation of its Strategic Plan. The private sector is seen as the key driver of socio-economic transformation and enabler of economic growth in an emerging Africa, therefore, any initiative that attempts to increase the participation of this important business and non-governmental constituency in Global Internet Governance will no doubt strengthen the multi-stakeholder work of ICANN. DCA Trust has already submitted a copy of the IBCA proposal to ICANN through Mr. Tarek Kamel, and will also avail copies to the ICANN leaders.

The Walking Dead game for iPhone and iPad review

The Walking Dead game for iOS is lurching towards parity with its PC counterpart, having recently launched episode three of its zombie-filled storyline. The survival-horror game puts you in the shoes of Lee, who has been thrust into protecting a small girl from the horrors of a ravaged world while running from his own checkered past. The cel-shaded art style mimics the original comic series, but still maintains its own independent plotline that grows every episode.

Graphics and audio

Telltale has done a great job of expressing convincing human emotion through the slightly-exaggerated art style and the superb voice acting. The soundtrack ranges from frantic to foreboding, and sets an excellent mood no matter which situation you find yourself in. I occasionally experienced user interface glitches when conducting dialog, where completely different options would be selected from what I tapped. The framerate on the iPad 2 would also drop during the odd fast-paced section and lip syncing wasn?t quite as good as I was hoping it would be, but still close enough to its PC version.?

Though this might go without saying, The Walking Dead, as a game about zombies, is full of gore, violence, and swearing. It?s not senseless mind you, but it might be a little too much for sensitive players, and definitely not appropriate for kids. On the other hand, the graphics are outstanding if you're a fan of horror; the action sequences when you're being ambushed by the undead can really get the heart pumping.

Gameplay and controls

The Walking Dead Game is busted up into three major gameplay types. One is picking dialog options with lasting effects throughout the rest of the series, sometimes on a timer. Another type is combat, whichvinvolves fending off zombie attacks with rapid-fire taps on target areas and appropriate swipes. Lastly, there are puzzle sections that involve finding items and using them with others to accomplish certain tasks. These are slightly less frustrating than those in old-school point-and-click adventure games, since every object you can interact with has a target icon over it. The only time the puzzles get really challenging is when you don?t have a lot of time to make your decisions.?

The Walking Dead occasionally errs on the side of dramatic camera angles instead of practical ones, though by and large it?s easy enough to get by. Dragging your finger across the screen will dictate where Lee walks when in a free-movement sequence, while the more fast-paced action scenes involve precise, rapid taps and swipes. Let it be known that facing off against zombies is just as scary and time-sensitive as the dialog-based encounters that will often put you in the position of making life-or-death decisions. Even the more subtle dialog can have lasting repercussions throughout future episodes. Though there's some replay value in exploring the different plot branches, they're a bit limited once you know the eventual outcome and major progression points, kind of like a Choose Your Own Adventure book.

One particularly interesting thing The Walking Dead Game does is compare the major decisions you make against those of other players at the end of every chapter. Some of the stats that they've generated about certain decision points can be fairly surprising.?

The bottom line?

The Walking Dead is a little pricey at $4.99 per episode, even if you get the whole set for $14.99, but the writing and story are so excellent that you may be willing to drop the extra dough on such a high-quality experience. Though there is a fair bit of replay value available as you discover the various paths and turns the plotline can take, you probably only have two or three play-throughs before most of the major options have been explored.?

If you?re looking for something to get you into the Hallowe?en spirit, be sure to give at least the first episode a shot. The Walking Dead is a unique, thrilling experience that's rich with drama.?

Stepdad: Border guard shooter sent text to mother

SEATTLE (AP) ? An unarmed Canadian border guard shot in her booth at a busy U.S.-Canada crossing north of Seattle was on her way to a full recovery Wednesday as investigators worked to determine why a 32-year-old tattoo artist from Washington state fired at her before committing suicide.

Andrew Michael Crews of Seattle was driving a van into Canada when he shot Officer Lori Bowcock in the neck Tuesday afternoon at a border crossing at Blaine, then turned the gun on himself, authorities said. Crews died at the scene.

His stepfather, Danny Lupinek of Henderson, Nev., said Wednesday that Crews texted his mother hours before the shooting to say he loved her ? and was sorry.

Lupinek said Crews didn't explain what he meant in his text, and the family was unable to reach him after that. He said Crews had given no indication he was upset or headed to Canada.

Meanwhile, investigators also tried to piece together a motive for Crews' actions.

"The current evidence clearly indicates that prior to taking his own life, Mr. Crews deliberately fired at the victim," said Superintendent Kevin Hackett of the British Columbia homicide investigative team handling the probe. "There is no evidence, however, to suggest the victim was specifically targeted."

He did not elaborate.

Agents with Homeland Security Investigations were assisting British Columbia authorities by following leads on the U.S. side of the border, said Andrew Munoz, spokesman for the U.S. Immigration and Customs Enforcement.

Bowcock remained hospitalized Wednesday in British Columbia.

"She is in stable condition and is expected to make a full recovery," Roslyn MacVicar, the Canada Border Services Agency's Pacific regional director, said in a statement. "Her mother and brothers are by her side."

Bowcock worked as a civilian dispatcher at police headquarters in London, Ontario, until last spring. As a new border guard, she had not yet completed training that would allow her to carry a gun, the Border Services Agency said.

Crews had lived in the Bremerton area but recently moved to the Seattle area.

Friends said Crews had worked at a Lucky Boys tattoo parlor in Silverdale, near Bremerton, and Lupinek confirmed that his stepson had worked as a tattoo artist. Lucky Boys' phone rang unanswered late Wednesday.

"He's nice. He's just really down to earth," tattoo client Courtnee Riggs told KOMO-TV of Seattle. "He seemed normal and happy and liked punk rock. It's just crazy."

KING-TV reported Crews also had worked at Under the Needle Tattoo in Seattle. A man who answered the phone there declined to comment.

Immediately after the shooting, officers swarmed the scene and closed the Peace Arch border crossing as they interviewed witnesses and searched for clues. Investigators blocked off the area around Bowcock's booth with yellow crime-scene tape and examined Crews' white van, which sat with its back doors open revealing a mattress inside.

Kevin McAllister, assistant general manager at the Peace Portal Golf Course, which is adjacent to the border crossing, said an employee and several guests told him they had heard two shots fired.

The Peace Arch border about 100 miles north of Seattle is the third-busiest between the United States and Canada. Last month, it averaged 9,000 U.S.-bound cars a day, according to U.S. Customs and Border Protection.

Canadian officials reopened the crossing's southbound lanes Wednesday afternoon. The northbound lanes were scheduled to reopen Thursday.

In the meantime, drivers were diverted to other crossings, including the nearby Pacific Highway crossing, said U.S. Customs and Border Protection spokesman Mike Milne.

Washington Gov. Chris Gregoire said she spoke to British Columbia Premier Christy Clark and pledged the state's cooperation and help in the investigation.

"This tragedy hits especially close to home, and reminds us all that our public safety officers put their lives on the line every day to protect the rest of us," Gregoire said.

Her remarks were echoed by the president of the Canada Border Services Agency.

"This is a profound reminder of the risks that border services officers assume every day," Luc Portelance said in a statement from Ottawa. "I know that the courage and dedication of our officers are second to none."
